Terms of Services

Welcome to Ping N Pickle. These Terms of Service ("Terms") govern your access to and use of the Ping N Pickle mobile application, website, and related services (collectively, the "Services").

By accessing or using Ping N Pickle, you agree to be bound by these Terms. If you do not agree, do not use the Services.

 

1. ABOUT PING N PICKLE

Ping N Pickle is a platform designed to help users discover pickleball courts, connect with local playing opportunities, and access information related to pickleball activities and facilities.

Ping N Pickle does not own, operate, supervise, or control any pickleball courts, facilities, events, leagues, tournaments, or activities listed within the Services unless expressly stated.

2. ELIGIBILITY

You must be at least 13 years old to use the Services.

By using Ping N Pickle, you represent and warrant that:

  • You are at least 13 years of age.

  • You have the legal capacity to enter into these Terms.

  • You will comply with all applicable laws and regulations.

3. ACCOUNT RESPONSIBILITIES

If you create an account, you agree to:

  • Provide accurate information.

  • Maintain the security of your account credentials.

  • Notify us immediately of unauthorized access.

  • Accept responsibility for activities conducted through your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. ACCEPTABLE USE

You agree not to:

  • Violate any law or regulation.

  • Harass, threaten, or abuse other users.

  • Submit false or misleading information.

  • Attempt to gain unauthorized access to systems or accounts.

  • Distribute malware, viruses, or harmful code.

  • Interfere with the operation of the Services.

  • Use the Services for fraudulent purposes.

  • Scrape, copy, or harvest data without authorization.

5. USER CONTENT

Users may submit content including:

  • Profile information

  • Reviews

  • Feedback

  • Messages

  • Suggestions

  • Photos (if applicable)

You retain ownership of content you submit.

By submitting content, you grant Ping N Pickle a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such content for purposes of operating and improving the Services.

You represent that you own or have permission to share any content submitted.

6. LOCATION SERVICES

Certain features may require access to your device location.

By enabling location services, you authorize Ping N Pickle to use location information to:

  • Display nearby courts

  • Improve search results

  • Enhance user experience

You may disable location permissions through your device settings at any time.

7. COURT AND FACILITY INFORMATION

Ping N Pickle strives to provide accurate information but does not guarantee:

  • Court availability

  • Court conditions

  • Operating hours

  • Facility policies

  • Event schedules

  • Tournament information

Information may change without notice.

Users should independently verify information before relying on it.

8. ASSUMPTION OF RISK

Participation in sports and recreational activities involves inherent risks.

By using Ping N Pickle, you acknowledge and agree that:

  • Participation in pickleball activities is voluntary.

  • Physical activity carries risk of injury.

  • Ping N Pickle is not responsible for injuries, damages, losses, or accidents occurring at courts, facilities, events, or activities.

You assume all risks associated with participation.

9. DISCLAIMERS

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PING N PICKLE DISCLAIMS ALL WARRANTIES, INCLUDING:

  • MERCHANTABILITY

  • FITNESS FOR A PARTICULAR PURPOSE

  • NON-INFRINGEMENT

  • ACCURACY OF INFORMATION

  • UNINTERRUPTED AVAILABILITY

We do not guarantee that the Services will always be secure, error-free, or available.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

PING N PICKLE, ITS OWNERS, EMPLOYEES, AFFILIATES, CONTRACTORS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR:

  • INDIRECT DAMAGES

  • INCIDENTAL DAMAGES

  • SPECIAL DAMAGES

  • CONSEQUENTIAL DAMAGES

  • LOSS OF DATA

  • LOSS OF PROFITS

  • PERSONAL INJURY

  • PROPERTY DAMAGE

ARISING FROM OR RELATED TO THE USE OF THE SERVICES.

If liability is imposed despite these limitations, our total liability shall not exceed the amount paid by you to Ping N Pickle during the preceding twelve (12) months.

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Ping N Pickle and its officers, employees, affiliates, and representatives from any claims, damages, liabilities, costs, and expenses arising from:

  • Your use of the Services

  • Your violation of these Terms

  • Your violation of any law

  • Content you submit

12. INTELLECTUAL PROPERTY

All rights, title, and interest in the Services, including:

  • Logos

  • Branding

  • Trademarks

  • Designs

  • Graphics

  • Software

  • Content

remain the exclusive property of Ping N Pickle or its licensors.

No rights are granted except as expressly stated in these Terms.

13. THIRD-PARTY SERVICES

The Services may contain links to third-party websites, facilities, businesses, maps, or services.

Ping N Pickle is not responsible for:

  • Third-party content

  • Third-party policies

  • Third-party products or services

Your use of third-party services is at your own risk.

14. TERMINATION

We reserve the right to suspend or terminate access to the Services at any time for:

  • Violations of these Terms

  • Fraudulent conduct

  • Abuse of the platform

  • Security concerns

  • Legal compliance requirements

Termination may occur without prior notice.

15. CHANGES TO THE SERVICES

We may modify, suspend, or discontinue any portion of the Services at any time without liability.

We are not obligated to maintain any specific feature or functionality.

16. PRIVACY

Your use of Ping N Pickle is also governed by our Privacy Policy.

By using the Services, you acknowledge that you have reviewed the Privacy Policy.

17. GOVERNING LAW

These Terms shall be governed by and interpreted under the laws of the State of Ohio, without regard to conflict-of-law principles.

18. DISPUTE RESOLUTION

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in the State of Ohio, except where prohibited by law.

Users agree to waive participation in any class-action lawsuit or class-wide arbitration.

19. SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

20. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Ping N Pickle regarding use of the Services and supersede all prior agreements or understandings.
